It is an animal, not a plant. Without getting too theological, humans are also considered animals, so it could be a human.

hmmm... well, I would like to point out that there are more kingdoms than Animalia and Plantae, there are also Fungi, Protista, and Monera.

About the animals, I took two courses with this professor named Joe Skulan, my room mate calls him Crazy Joe. He convinced me to use Cladistics when thinking about taxonomy. It's much better, I think, for figuring out how animals are actually related. At the same time it usually just brings up more questions. Skulan is a paleontologist, and uses Cladistics to teach how the dinosaurs are related.
